Eighth Amendment officially scrapped as referendum bill signed into law

President Michael D. Higgins has signed the Thirty-Sixth Amendment of the Constitution Bill 2018 into law, removing the Eighth Amendment from the Constitution.

The Protection of Life During Pregnancy Act 2013 will continue to govern Ireland’s abortion law until new legislation is enacted by the Oireachtas.

Under the 2013 Act, pregnant people can access abortion as a last resort where their lives are at ‘real and substantial’ risk and the foetus is not yet viable, Aboutthe8th.com states.

The last legal challenge to implementing the outcome of the abortion referendum was dismissed by the Supreme Court earlier this month.

The court said there were no grounds to hear an appeal of a case dismissed by the Court of Appeal as “a frustration of the democratic process”.
