Law Society raises concerns over rights of way registration deadline

The Law Society of Ireland has raised concerns about the impending deadline for registration of rights of way created by long use.

Under the Land and Conveyancing Law Reform Act 2009, rights of way created by long use must be registered with the Property Registration Authority of Ireland (PRAI) by 30 November 2021.

The Law Society wrote to the Department of Justice in May to call for a six-month extension to the deadline, the Irish Independent reports.

Highlighting “widespread concern” around the provisions, which it said have “far-reaching implications”, the Law Society suggested the laws should be subject to a further review.

The provisions on rights of way had created serious problems for solicitors and their clients in relation to house sales in rural areas, where residents often rely on rights of way to access their homes, the Society said.
