A judge has excoriated a police official who confused her with a defendant and said he had tried and failed to arrest her on foot of a non-existent warrant.

Magistrate Nagma Khan, a senior judge in the Indian state of Uttar Pradesh, demanded an investigation after the mix-up came to light in court, Indian legal publication Bar and Bench reports.

The error was not caught until an oblivious police official addressing Magistrate Khan in court said that police were unable to arrest “Nagma Khan” at her home because she was not there.

Not only had the judge’s name been incorrectly written on paperwork in place of the defendant’s name, the police also appeared to think that an arrest warrant had been issued when it had not.

The judge had in fact issued a “proclamation” — a last opportunity for the defendant to present themself to the court — instead of a warrant.

It is “quite bizarre that the serving officer of the concerned police station has little to no idea of what was sent by this court, who exactly sent it and against whom”, the judge said.

She said an investigation was necessary in light of “the gravity and seriousness of the matter and the sheer outright negligence on the part of the police person concerned”.
