The state of Georgia cannot sue a charity for republishing an annotated version of its official legal code, the Supreme Court of the United States has narrowly ruled.
The annotated code, produced by legal publisher LexisNexis, was only available for a fee until Public.Resource.Org republished it online, Ars Technica reports.
The state of Georgia claimed copyright over the annotations and successfully sued the non-profit.
Although PRO successfully overturned the ruling in a state-level appeal court, they referred the case to the Supreme Court in a bid to set a nationwide precedent.
The court backed the non-profit’s argument that official documents of the state legislature cannot be copyrighted by 5-4.
