Judge Bernd Zabel, a judge in Ontario, Canada, wore the cap while presiding on 9 November 2016, one day after Donald Trump’s surprise election as President of the United States.

A transcript of the day’s proceedings suggests that he wore the hat to annoy “the rest of the judges”, who he said “all voted for Hillary”.

He issued a public apology for his actions a few days later.

Judge Zabel’s conduct will be the subject of a public hearing on 23 August, where he could face disciplinary action ranging from a warning or reprimand to a suspension from his judicial duties.
