Ballaghaderreen solicitor ordered not to practise during tribunal proceedings
Ballaghaderreen solicitor Declan O’Callaghan has been ordered not to practise as a solicitor pending the outcome of Solicitors Disciplinary Tribunal proceedings, The Irish Times reports.
Mr O’Callaghan had asked the High Court last month to be allowed to continue practising under the supervision of another solicitor.
The Solicitors Disciplinary Tribunal is currently looking into allegations that he withdrew €344,000 in excessive fees from a bereaved child’s €454,840 estate.
However, Mr Justice Peter Kelly ordered Mr O’Callaghan to surrender his practising certificate to the Law Society of Ireland and may not practise, apply for another certificate or advertise himself as a solicitor.
He is also banned from any involvement with Kilraine O’Callaghan, where he was partner, or a second unnamed firm.
Kilraine O’Callaghan will continue practising under the stewardship of Aoife and Eimear O’Callaghan, solicitors and daughters of Mr O’Callaghan.
Brendan Steen, a solicitor approved by the Law Society, will be joint practice manager and sole signatory on the client account for the firm.
