Belfast student loses bid for right to vote in abortion referendum
The High Court in Dublin has refused an application for judicial review from a Belfast student challenging the State’s failure to allow citizens living in Northern Ireland to vote in the abortion referendum.
Mr Justice Charles Meenan said the application brought by Roisin Morelli, 26, falls well short of being arguable.
The judge said the franchise for elections and referendums could not be extended beyond what is allowed by the Constitution.
He said that Article 47.3 creates a clear link between voting in the Dáil and in referendums, and Article 3 was incompatible with legislation to divide Northern Ireland into voting constituencies.
The judge did not make an order on costs.
