Conveyancers frustrated by new Land Registry rules
Conveyancing solicitors have raised concerns about a change of practice at the Land Registry meaning that rejected applications no longer come with an explanation for the decision.
The Tailte Éireann website now states: “In cases where an application is not in order for registration, we will issue a rejection notice and return the application, together with a copy of a checklist outlining the common reasons for rejection.”
The Law Society’s conveyancing committee has criticised Tailte Éireann for failing to consult on the changes before bringing them into effect.
In a statement published to the Law Society website, the committee said it met with representatives from Tailte Éireann earlier this month and called on them to suspend the new practice pending further consultation, but it was “made clear” that this would not happen.
“The Law Society will continue to engage with Tailte Éireann in relation to this change and will issue further guidance as soon as possible,” the statement continues.
“In the interim, if practitioners are satisfied that a rejected application is in order it should be relodged promptly.”
Tailte Éireann did not respond to a request for comment from Irish Legal News by time of publication.
