Damages claim derailed after Facebook photos shown to court
A woman’s claim for damages after a minor accident was thrown out of court after a judge agreed subsequent Facebook photos showed she had a “fine physical physique”, the Irish Independent reports.
Rita Milinovic, 29, told Dublin Circuit Court that her life was changed after a minor motor accident in a car park and made a claim for €60,000 in damages against van driver Paul Ferris and O’Dwyer Property Management Limited.
However, the case was defeated when barrister Shane English showed the court photos of Ms Milinovic participating in sports and competing in fitness competitions after the incident.
Mr Justice Raymond Groarke concluded that Ms Milinovic was a “very fine human specimen who is clearly in the best of physical condition”.
Mr English criticised the claimant for failing to disclose her sports hobbies and alleged that she had falsely denied holding a gym membership.
Mr Justice Groarke said: “Trying to be as politically correct as one can be in this situation, it does not look like a person with such a fine physical physique as Ms Milinovic has could have been suffering a great deal of pain.
“The person we see in these photographs is a very fine human specimen who is clearly in the best of physical condition and who has been working to get into that physical situation.”
