Dozens of wrongly convicted motorists ‘seeking to sue State’
The State is facing lawsuits from dozens of motorists who were wrongly convicted in the fixed charge notice scandal and say they do not consent to gardaí appeals on their behalf.
Killarney solicitor Padraig O’Connell told the Irish Examiner that the State and gardaí are appealing a number o the wrongful convictions “without recourse to the convicted person’s legal advisor”.
He said he had received consent forms for his clients to sign, consenting to gardaí commencing the process of appealing the conviction, but none of them had signed the forms.
Mr O’Connell said: “I have told the Garda Headquarters in the Phoenix Park that I am suing the State, pursuing a claim for damages, in the appropriate cases to include exemplary damages.”
He said he was pursuing the matter in Tralee Circuit Court on behalf of dozens of motorists with convictions as far back as nine years ago.
