Drink driving arrest ruled lawful despite use of handcuffs
A High Court judge has ruled that a drink driving arrest was not unlawful despite the use of handcuffs, The Irish Times reports.
A garda arrested the man on suspicion of drink-driving after he went around a Co Louth roundabout before exiting at the same road it had entered, then kitting the kerb and veering to the left.
Mr Justice Michael Moriarty stressed that the case was more nuanced than another case where the Supreme Court ruled that the use of handcuffs were unlawful.
In that case, the garda said he always used handcuffs while making an arrest.
Mr Justice Moriarty said the use of handcuffs in this arrest was not unreasonable and did not render the arrest unlawful.
