ECtHR intervenes in deportation of suspected terrorist recruiter
The European Court of Human Rights (ECtHR) has granted a temporary stay on the deportation of a man alleged to be the Islamic State militant group’s “main recruiter” in Ireland.
Ms Justice Carmel Stewart, sitting in the High Court, had earlier agreed to overturn an injunction preventing the execution of a deportation order issued to the man in November.
However, an interim order preventing the man’s deportation has since been issued by the ECtHR after new proceedings were launched by the man in Strasbourg.
The man, who is married and has resided in Ireland for 15 years, cannot now be deported until those proceedings are complete.
The European court made the order because of arguments that the man could face torture if returned to his home country.
There is no automatic stay in the Irish courts when an issue under article 3 of the European Convention on Human Rights is raised.
However, the ECtHR has yet to rule on whether the case can proceed to a full hearing.
