England: Black cab manufacturer’s attempt to trademark design fails
The Court of Appeal has rejected an attempted to trademark the shape of London’s black cabs, upholding a decision of the High Court from last year that the shape lacked “distinctive character”.
The London Taxi Company, manufacturer of the hackney carriages, had taken the firm Frazer-Nash to court, arguing its Metrocab design “substantially copied” the black cab.
But Mr Justice Arnold’s ruling has been upheld by Lord Justice Kitchin and Lord Justice Floyd on appeal.
The London Taxi Company has said it may appeal to the Supreme Court.
