England: QC caught having sex with solicitor outside Waterloo station has record expunged
A QC who was cautioned by police after she was found having sex with a solicitor outside Waterloo station in London has had her criminal record expunged after claiming she was drunk.
The barrister admitted outraging public decency when she was arrested along with Graeme Stening, 53, after being spotted having sex with the latter in front of commuters during rush hour.
However, six weeks later she said she could not remember the incident and must have been too drunk to consent to sex. As such, she applied to have her admission to police overturned.
As an alleged victim of a sexual offence, the middle-aged woman has been given lifetime anonymity.
Mr Stening initially denied outraging public decency, but ultimately accepted a caution.
The barrister appealed against the police decision not to prosecute Mr Stening but a senior officer upheld a ruling of insufficient evidence.
Amarjit Bhachu, Mr Stening’s lawyer, said he had hoped police would investigate the woman.
He said: “It was apparent from the outset that the complainant’s motive was to obtain anonymity.
“Despite the police taking the decision not to take any further action, the complainant has achieved exactly what she wanted by taking this calculated course of action.”
As the QC’s caution has been expunged, she is unlikely to face any disciplinary proceedings. Mr Stening has reportedly referred himself to the Solicitors Regulation Authority.
