The family of a woman who was killed when she was struck by a Garda car are to bring a judicial review against an “outrageous” decision not to prosecute the garda involved.

Belfast firm Madden & Finucane Solicitors is representing the family of Rebecca Browne, a 21-year-old from Derry who was killed on 21 May 2023 at Ludden, near Buncrana, Co Donegal.

The Garda Síochána Ombudsman Commission (GSOC) this week told the family that the Office of the Director of Public Prosecutions had decided not to prosecute the garda involved in the collision.

Conor Moylan, the family’s solicitor, said: “Rebecca’s family have been let down by the Irish State and are devastated by this decision. The DPP did not have the courtesy to consult the Browne family in relation to their decision.

“We have requested the full written reasons, together with all documents, consultation notes, expert opinions and reports, and memoranda which have given rise to this decision.

“It is our intention to challenge this decision by way of judicial review.”
