Fianna Fáil member fails in challenge to gender quota law
A member of Fianna Fáil has lost his legal challenge against Irish gender quota laws which allow for State funding to be cut where fewer than 30 per cent of a party’s candidates are women.
Brian Mohan launched the legal action in the High Court after party members in Dublin Central were told to pick a female candidate to contest the general election.
However, Mr Justice David Keane said that was a decision made by the party rather than enforced by the Electoral (Political Funding) Act 2012.
He ruled that Mr Mohan did not have the necessary standing to bring the action as he failed to prove the alleged unconstitutionality of the law had adversely affected him.
Mr Mohan’s barrister, Michael McDowell SC, said his client intends to appeal the decision and the costs order against him.
