The case also raised “important questions of freedom of speech in Parliament, the separation of powers and the extent to which the court may intervene in the affairs of the Legislature”.
In all the circumstances, the Court was satisfied that justice of the case would be met if Ms Kerins was “awarded two thirds of her taxed costs against the first to fifteenth respondents together with 100% of the costs of the transcript”.
The Court also found in favour of Ms Kerins in making no order for costs in favour of the final two respondents, Ireland and the Attorney General.
