High Court overturns ‘right to be forgotten’ ruling
The High Court has overturned a ruling in favour of a man in Ireland’s first “right to be forgotten” case, the Irish Examiner reports.
Mark Savage had complained to the Data Protection Commissioner over Google’s refusal to remove links to a page where he was described as “homophobic”.
The allegation was based on materials handed out during his 2014 local election campaign in which he complained about “gay perverts cavorting en flagrante on the beach on broad daylight”.
The Commissioner ruled against Mr Savage, but her decision was subsequently overturned by Dublin Circuit Court in October 2016.
However, sitting in the High Court in Dublin, Mr Justice Michael White reinstated the Commissioner’s decision because, he said, Dublin Circuit Court had not identified a serious error of law or fact.
