High Court to hear challenge to GoSafe evidence in speeding cases
Judge Patrick Durcan has ruled that GoSafe employees have no authority to give evidence in criminal proceedings against drivers accused of speeding.
The GoSafe consortium is contracted to operate safety cameras on behalf of An Garda Síochána.
In a test case before Ennis District Court yesterday, Judge Durcan ruled GoSafe employees should have a warrant to give them specific powers to carry out their duties, according to the Irish Examiner.
However, he said the case should go to the High Court in order to remove any uncertainty over the issue.
Solicitor Daragh Hassett, partner at Hassett Considine Solicitors, and Garda Insp Tom Kennedy will have two weeks to agree terms for the High Court case.
