Judge recuses himself from Blackrock Clinic proceedings
Mr Justice Robert Haughton has recused himself from long-running proceedings over control of Blackrock Clinic Ltd because he criticised one of the parties to the case in a separate judgment, the Irish Independent reports.
Breccia requested the recusal after Mr Justice Haughton said, in a November 2017 judgment, that the company had displayed a “lack of candour” in seeking injunctions against Dr Joseph Sheehan concerning his shareholding in Blackrock Hospital Ltd (BHL).
BHL owns the share capital of Blackrock Clinic Ltd, and Dr Sheehan’s shareholding is at the centre of the Blackrock Clinic litigation.
The litigation will now be case managed by Mr Justice Michael Twomey, who becomes the fourth judge to oversee the case.
