Judge subjected to lewd display will not be called to testify
Judge Patrick Durcan will not be called to testify in the trial of a man who made a lewd display at a sitting of Ennis District Court last year.
Brian Joyce, 21, has pled guilty to a charge under section 6 of the Public Order Act 1994 of engaging in threatening, abusive or insulting behaviour with intent to provoke a breach of the peace, the Irish Examiner reports.
The bizarre act involved Mr Joyce exposing his genitals to the judge before causing a wider disturbance in the courtroom, during which his brother - John Joyce, 19 - assaulted a court garda.
John Joyce has been charged with assault and breach of the peace.
Tara Godfrey, solicitor for the brothers, told Ennis District Court yesterday that both were pleading guilty to their respective charges.
Garda Inspector Tom Kennedy then confirmed that Judge Durcan would not be called as a witness in their trials.
The two brothers were remanded in custody with consent to bail.
