Law Society of Northern Ireland resisting judicial review over disciplinary tribunal orders

Judicial review proceedings have been brought against the Law Society of Northern Ireland in relation to the disclosure of orders of the Solicitors’ Disciplinary Tribunal for Northern Ireland.

Granite Legal Services is challenging a decision by the Law Society’s registrar not to hand over copies of all orders made by the tribunal and held by the Society’s registrar since 1998 following a request.

The Law Society publishes a synopsis of tribunal cases in its annual report, but only names solicitors who have been struck-off or suspended.

It is resisting the legal challenge on the basis that disclosing tribunal orders to Granite would involve disclosing the names and personal details of solicitors who have been made subject to tribunal orders not contained in the published synopsis.

Mr Justice McAlinden last week directed the Law Society to advise solicitors in Northern Ireland about the proceedings and invite them to offer their view.

Solicitors wishing to make a representation should email the registrar, who will bring them to the attention of the court, at registrar@lawsoc-ni.org no later than 21 October 2024.
