Ms Y launches civil action against the State
A refugee at the centre of a high-profile abortion controversy has launched a civil action for damages against the State.
Ms Y is an asylum seeker who arrived in Ireland in early 2014 and unsuccessfully sought an abortion after discovering that she had become pregnant as a result of rape in her home country.
She is making a claim for alleged trespass, assault and battery; alleged negligence; alleged reckless and intentional infliction of emotional harm and suffering; alleged breach of duty; alleged false imprisonment; and alleged unlawful deprivation of liberty.
The High Court in Dublin has made an order under the Refugee Act 1996 to prevent the woman from being identified.
Mr Justice Kevin Cross ruled that she should continue to be identified during proceedings as Ms Y from Dublin.
