‘No barrier’ to bilateral UK-Ireland extradition deal in event of a hard Brexit
An Irish extradition expert has said there is no barrier to Ireland and the UK striking a bilateral extradition agreement in the event of a hard Brexit, The Irish Times reports.
Anthony Hanrahan, a barrister and author of The European Arrest Warrant in Ireland, discussed the possibility of a hard Brexit at a Dublin conference organised by SAR Consultancy.
He said there are no legal barriers to making a bilateral arrangement outside of the EU, though warned that the UK would have more difficulty concluding agreements with the 13 other EU countries which do not allow their citizens to be extradited to countries outside the EU.
Mr Hanrahan noted that, prior to the introduction of the European Arrest Warrant in 2002, extradition requests between Ireland and the UK were handled under a 1957 bilateral agreement.
However, he added that it was “unimaginable” that a new bilateral arrangement would include the same exception for “political offences” as the 1957 deal.
