Public to gain access to written submissions in High Court cases

Members of the public will be able to seek access to written submissions in High Court cases from early next year, the court has announced.

In a new practice direction, Ms Justice Mary Irvine, president of the High Court, said the move was being made “in the interests of transparency and consistent with the principle of open justice”.

The new rules will take effect from 11 January 2021 and will require lawyers to draw up redacted version of documents for public release where necessary.

Parties to civil proceedings will have to take cognisance of the obligation in data protection law of data minimisation as well as ensuring that public versions of submissions “do not contain scandalous, abusive or vexatious material”.
