QCs tell May that Article 50 can be unilaterally withdrawn
Senior barristers have told Prime Minister Theresa May that the UK can unilaterally withdraw the Article 50 notification and halt the Brexit process, The Brief reports.
Jessica Simor QC (of Matrix Chambers in Gray’s Inn), Tim Ward QC (of Monckton Chambers in Gray’s Inn) and Marie Demetriou QC (of Brick Court Chambers in the Temple) wrote to Ms May to offer their legal opinion as the Brexit bill continues to move through Parliament.
They say withdrawing the notification “would be a matter for parliament and the executive but legally there is nothing to prevent it from happening”, as long as it is done before the 29 March 2019 exit date.
In an accompany letter, Ms Simor adds that if UK negotiators are “unable to secure a good deal or no deal is secured, the United Kingdom retains the option to remain within the EU”.
