NI: RHI court case could go to UK Supreme Court
A court battle over the future of the Renewable Heat Incentive (RHI) scheme could make it to the UK Supreme Court following a decision on costs.
The Renewable Heat Association for Northern Ireland (RHANI), which represents half of RHI boiler owners, took the Department for the Economy to court over cuts to the scheme.
RHANI was knocked back in the High Court but intends to appeal.
The Department has now agreed to a costs cap whereby RHANI will only be liable for up to £15,000 of the Department’s legal costs if the Department wins, and the Department will only be liable for up to £35,000 of RHANI’s legal fees should its appeal succed.
The agreement makes it significantly more affordable for RHANI to take the case to the UK Supreme Court if their initial appeal fails.
