NI: Trans woman brings judicial review over gender recognition laws
A transgender woman has brought judicial review proceedings arguing that the requirement to have a medical diagnosis in order to obtain a gender recognition certificate (GRC) breaches her human rights.
Solicitor Ciarán Moynagh of Phoenix Law is representing the anonymous woman in the proceedings brought against the Government Equalities Office (GEA), the Belfast Telegraph reports.
The case, which has begun in the High Court, focuses on the requirement under the Gender Recognition Act 2004 for a medical diagnosis of gender dysphoria, which the applicant contends is stigmatising and unnecessary.
Mr Moynagh said: “The lack of treatment, support and medical expertise in Northern Ireland that assists trans people in obtaining a GRC is a long-standing issue that the government has acknowledged but taken no steps to resolve.”
