Two cases dropped in wake of suspended sentences ruling
Two cases where a suspended sentence was to be activated have been dropped in the wake of the High Court ruling on Tuesday.
Mr Justice Michael Moriarty declared that section 99 of the Criminal Justice Act 2006, governing the activation of suspended sentences, is unconstitutional.
The ruling’s implications are being urgently examined by the Department of Justice and Attorney General Máire Whelan.
Yesterday, the State requested that “no order” be made in two cases in light of the recent ruling.
A homeless 23-year-old woman convicted of false imprisonment and a homeless 21-year-old man will leave court without rebuke after having allegedly violated the terms of their suspended sentences.
Acting Justice Minister Frances Fitzgerald has said emergency legislation to fix the law could be introduced “within days”.
