US: Man exposes penis in court to prove innocence
A man on trial for a sex crime exposed his penis in court to contradict the complainant’s claim it was a lighter colour than the rest of his body.
Desmond James, 26, who is on trial in New Haven, Connecticut, was permitted to reveal his member by the judge, the New York Post reports.
The woman who accused him of rape said the man who attacked her had a penis that was lighter than the rest of his body.
Mr James’ lawyer made the counterclaim that his client’s penis was in fact darker than the rest of him.
Judge Elpedio Vitale allowed the request, saying it was within the ambit of the Sixth Amendment, which covers a fair and expeditious trial.
Mr James exposed himself in the middle of the courtroom, prompting laughter and shocked reactions.
His lawyers said in his closing statements: “You may have noticed because of my client having to show his penis … the gallery’s a little more full today.”
Prosecutors attempted to cast doubt on the evidence, saying that six years had elapsed since the alleged crime and that many changes could have occurred since then.
Stacey Miranda, prosecuting, said: “You saw the defendant’s penis - what was that?!
“It is six years later. Do we have any idea of what she may have been seeing that night? What his manscaping was like at the time? What light was shining on it?”
