Volkswagen case back on the road

District court judge Mary Devins yesterday continued to hear a case against German car manufacturer Volkswagen over their admitted cheating on diesel emissions levels - despite a walk-out on Tuesday by barrister Paul Fogarty, (pictured) and two solicitors from A&L Goodbody who disputed the court’s jurisdiction and said they would seek a judicial review if the case proceeded at Castlebar District Court.
She described their actions as a “bizarre stunt” and “ one of the most unusual things” she had ever seen in court.
Judge Devins ruled the case would continue and agreed to consider an application for further discovery in relation to the car manufacturer after counsel for the complainant said the information provided was “inadequate”.
The action for compensation has been raised by Roscommon nurseEithne Higgins, of Croghan in Boyle, against Volkswagen Group Ireland and Volkswagen AG.
Following evidence from expert witnesses counsel for Ms Higgins, Evan O’Dwyer, requested a further order be made directing the car manufacturer to provide additional data in the case specifically information relating to the CO2 emissions and correspondence between the car manufacturer and German regulators.
Such information, he said, had already been provided to inquiries by theUS Senate and EU regulators.
Judge Devins asked Mr O’Dwyer provide her with a draft for further application of discovery. The case continues.
