A woman in Manhattan who sued her 12-year-old nephew after he jumped into her arms as he welcomed her to his eighth birthday causing her to fall and break her wrist has been awarded nothing.
Jennifer Connell, who sought $127,000, claimed the boy acted unreasonably in causing her to fall, but thankfully a Connecticut jury has decided she entitled to zero damages.
Upon seeing his aunt the boy shouted “Auntie Jen, I love you!” before leaping into her arms.
Ms Connell told the court she found “difficult to hold my hors d’oeuvre plate” at a party because of the injury.
Her lawyer, William Beckett, told the Daily News: “We do not take great pleasure in bringing a minor to court.
“She is not here enjoying a moment of this.”
He added: “We have rules for children.
“He was not careful. He was unsafe.”
