Chef awarded €13k for constructive dismissal
A chef who brought a claim for constructive dismissal against his former employer has been awarded over €13,000 by the Workplace Relations Commission (WRC).
Norman Tanju brought a complaint under the Unfair Dismissals Act 1977 against PBR Restaurants Ltd, which operates the Fish Shack chain of restaurants in Dublin.
The WRC awarded him €10,769 for lost earnings and a further €2,500 for continuing losses, totalling €13,269.
Mr Tanju was represented by Barry Crushell, principal solicitor at employment law specialist firm Crushell & Co.
Writing on LinkedIn, Mr Crushell said: “Claims for constructive dismissal are notoriously difficult to successfully progress. We were very pleased with this outcome for our client.
“Despite having a flexibility clause in his contract of employment, we argued that a change in working patterns, as an executive chef, working Monday to Friday, 9am to 5pm, across multiple establishments, to working as a head chef in a single restaurant, Wednesday to Sunday, 5pm to midnight, was an excessive application of that clause.”
