Civil justice review could look at code of practice for expert witnesses
Mr Justice Peter Kelly’s review of civil justice could be asked to consider the publication of statutory codes of practice for expert witnesses.
The publication of statutory guidance was recommended in a 460-page report published by the Law Reform Commission in January.
Fianna Fáil’s justice spokesperson Jim O’Callaghan told the Dáil that the measure “needs to be considered”.
Mr O’Callaghan said it was “important that experts who are retained by any side in a criminal or civil trial be aware that their overriding duty is to the court as opposed to being hired guns for either side”.
Justice Minister Frances Fitzgerald said the Law Reform Commission’s report “contains many recommendations”.
She added: “If there are recommendations that can be taken forward speedily, they can be examined. When I get the first report on the matter, we will be in a position to decide.
“The work by Mr Justice Peter Kelly’s group is progressing and basic arrangements are being put in place.
“That will be useful and could be a place from which we will get recommendations on the points raised by the Deputy.”
