Emergency suspended sentences law could come within two weeks

Emergency legislation to provide for the activation of suspended sentences is likely to be presented within two weeks after the relevant sections of the Criminal Justice Act 2006 were struck down.
The High Court last month found that the provisions are unconstitutional because they allow for significantly different treatment of people before the law in relation to their rights of appeal.
Making final orders in the case, Mr Justice Michael Moriarty yesterday struck down sections 99.9 and 99.10 of the Act.
Attorney General Máire Whelan failed in an application for the judge to stop short of striking down the law.
Legal sources now fear that more cases will be brought by prisoners seeking release after having their suspended sentences activated.
The drafting of legislation dealing with the consequences of the ruling is almost complete and a bill could be presented to the Oireachtas within two weeks, The Irish Times reports.
