High Court action over barrister's death ends in settlement

A barrister who sued a Dublin hospital for negligence over the death of her husband, a senior counsel, has agreed to an out-of-court settlement.

Bernadette Kirby BL launched legal proceedings against St John of God Hospital in the High Court in 2018 in connection with the death of Colm O’Briain SC in 2016.

An inquest ruled in 2018 that Mr O’Briain took his own life a few hours after he was admitted to the hospital.

The High Court proceedings were struck out in May, though issues relating to legal costs are still being heard, the Sunday Independent reports.

Mr O’Briain was a leading member of the criminal bar, appearing in many prominent trials, taking briefs both as prosecuting and defence counsel.

He was called to the Inner Bar just a year before he passed away after twenty-five years as a junior.
