High Court ruling brings end to garda court presenter system
A significant High Court ruling has effectively brought an end to the practice of gardaí presenting criminal cases to the District Court on behalf of their colleagues.
Until now, gardaí have regularly appeared in court to present cases in which they have no involvement on behalf of the prosecuting garda.
However, Ms Justice Marguerite Bolger yesterday clarified that the Garda Síochána Act 2005 only extends the right of audience to the prosecuting garda.
The ruling has already impacted some District Court cases and is expected to have a significant impact on Garda resources.
The Department of Justice and the Office of the Director of Public Prosecutions have said they are aware of the judgment and currently examining its implications.
