Judge overseeing personal injury list attacks insurers and media

The judge overseeing the personal injury list in the High Court has launched a scathing attack on the insurance industry, the media and parts of the judiciary, The Irish Times reports.

Mr Justice Kevin Cross wrote in The Bar Review it is “entirely untrue” inflated damages awards have led to increases in insurance premiums, rejecting arguments to the contrary from insurers and some judges.

He also said the “consistent campaign by the hidden persuaders has, it seems, subconsciously influenced the judges”.

Mr Justice Cross said damages awards had “dramatically decreased” since the 1970s when inflation is taken into account.

He also hit out at the Irish media for repeating insurance industry claims about award increases “without any scrutiny or comment”.

In his conclusion, he said that “to blame the increase of premiums on the level of general damages in the courts is entirely untrue”.
