UK Supreme Court grants two cross-appeals in Rwanda cases
The UK Supreme Court has received and determined applications for permission to cross-appeal in the following cases, often referred to as the Rwanda appeals:
- In the application of R (on the application of AAA and others) (Respondents) v Secretary of State for the Home Department) (Appellant), permission to cross-appeal is granted on Grounds 4 and 5.
- In the application of R (on the application of HTN (Vietnam)) (Respondent) v Secretary of State for the Home Department) (Appellant), permission to cross-appeal is granted on Grounds 4 and 5.
- In the application of R (on the application of AS (Iran)) (Respondent) v Secretary of State for the Home Department (Appellant), permission to cross-appeal (PTA) is refused on Ground 1 on the ground that the point is not arguable. PTA is refused on Ground 2 on the ground that there is no right of appeal, the point not having been the subject of an appeal to the court of Appeal, and the point is not arguable in any event. The panel considers that PTA is required in respect of the procedural Article 3 (Ilias), and grants PTA on that ground.
No further applications for permission to appeal are expected to be received.
These are the decisions on applications for cross-appeal. The Court of Appeal granted permission to appeal to the Secretary of State for the Home Department (SSHD).The SSHD’s Notice of Appeal was received by the Supreme Court in July 2023.
The court has also decided to allow the application of the United Nations High Commissioner for Refugees (UNHCR) to intervene in these appeals. The hearing is scheduled to take place 10.30am from Monday 9 October 2023 until Wednesday 11 October 2023.
The appeals will be heard by five justices, who will be confirmed nearer the time.
